Is it legal for a foreclosed home to be listed as a 5 bedroom home when the basement (containing two of the bedrooms) was finished without permits or inspections? We rented this home for three years, the owners let the house go into foreclosure. We submitted a bid to the bank then retracted it after researching it online to find out that there were not permits for the finished basement (it was last listed as a 3 bedroom home). The basement bedroom electrical kept frying out our sauna, treadmill, and TVs…now we know why! Is this simply a “buyer beware” situation?

The important thing in a real estate transaction is disclosure. If the buyer is aware of the situation and agrees to buy the house, as is, then there is no problem. It is impossible to list all of the defects of a house in a listing advertisement.
