what can i do legal to prevent a foreclosure?
the bank will not talk to me because my name is not on the loan but it is on the property i pay taxes and insurance in my name , the owner of the loan pased away , my cridit is not good enough to refinance
she filed a quit-claim deed before she died that we were joint tenants with rights of survivorship , so i have been living here the last three years paying for everything all up keep now the bank wants to foreclosure because i tryed to refinance
YOu have really got nothing here except tracking down the heir of the owner and seeing if you can work a deal with him.
Property belongs to his heirs; if they choose not to pay, the property defaults to the bank
uh..a quit claim deed filed after the mortgage was recorded is in line behind the mortgage in priority.
the lender is foreclosing their secured interest as pledged by your mother to secure a loan. She could have done a dozen deeds after that fact; won’t diminsh the priority of the lien.
