Postcards Foreclosure
My property is in foreclosure and I’m receiving a ton of mail… I have a couple questions about they laws…
My property is currently in foreclosure and I’m receiving a ton of junk mail related to it. The problem is that allot of the postcards and envelopes state things such as “save yourself from foreclosure”, “stop foreclosure”, etc… What I don’t like is this makes everyone aware (i.e. mail person, roommate, etc) aware of the situation.
I thought that I had seen something before that there are laws against anything like that being on the outside… can you please let me know if that’s correct or if I’m thinking of something else.

First of all, most of the general public isn’t going to read your mail. They could care less if you’re in foreclosure or not, since many of your neighbors are facing their own foreclosures.
Second, even people who aren’t in foreclosure get postcards like that about stopping foreclosure, applying for credit cards, getting out of debt, etc. You’re not the only one getting that mail, but you happen to be in foreclosure.
Anyone who wants to know about you being in foreclosure can find out in numerous other ways than reading your mail. It’s public records data, and anyone in the world can call the sheriff’s department or the county clerk and ask about the status of your property. They’ll be told that its in foreclosure, and they can also be told by the courts who is the defendant in the case (you) and who is the plaintiff (your bank). So the information isn’t that secure to begin with.
You can try sending these places back their mail unopened or with a big “Return to Sender” mark on it. That might cut down on the mail you’re getting. Or you can call the numbers on the mail and tell them to stop sending you information. But it’s not wrong for them to point out a condition of the property that is public knowledge.
