Can your HOA garnish your wages if you’re in foreclosure?
We are in the middle of foreclosure proceedings (stuck in a crappy ARM) and our HOA has served us with a “Standing Order for Interrogatories” last night. We had already told them we were going into foreclosure but they didn’t seem to care. We had been told they would put a lien on the house.
They can still put their lien, it is their right. A judge can still issue an order to garnish your wages if you are in the wrong. Your foreclosure would not have anything to do with your situation with the HOA, it is a separate bill and separate entity then your bank.
