I need a good template to follow in sending out my own foreclosure letter!?
Does anyone know where I can find one or a guide to follow in doing so. This guy was suppose to buy some property from my father and never fully paid for it. My father didn’t act on it and now years later its my responsibility to get the money or get him out. I want to send him the foreclosure letter myself and then foreclose on it if he doesn’t pay. I guess I would be serving notice that I will be foreclosing on the property if he doesn’t pay X amount of dollars in 45 days. He has been sent other letters through the years, but has never responded to them or picke dup certified letters that were sent to him. Does anyone know a free site that has legal forms like this that I could follow while I’m writing things up?
If order to save yourself alot of grief, you should first determine if you can simply file a Complaint to Evict the occupant, as opposed to a filing a full blown Foreclosure. To make this determination, you must find out the basis for the occupant’s possession of the premises. Is the basis for possession a Contract for Deed, a Lease, or a Mortgage Loan? If the occupancy signed a Mortgage and is in breach of the Mortgage terms, then Foreclosure is the proper legal method. You must locate a copy of the Mortgage and Note. The Mortgage is usually recorded in the County Recorder of Deeds’ Office. The Mortgage is not always recorded, in which case you will have to find it, because you will be required to attach a copy of the Mortgage to your Court Complaint.
If you want to know the steps to Foreclose, your State’s statutes list the steps for this procedure along with the time limitations. Each State has different procedures.. If you want to see the legal forms for Foreclosure for your State, go to the local Courthouse, and at the Court Clerk’s Office ask to see some Foreclosure case files. Page through the paperwork filed in those Foreclosure cases to see what is required. As always, you should seek an attorney’s assistance to get the proper results.
