Foreclosure Teachers
Can bank remove TENANT’s personal propery when they foreclose on landlord’s default?
A Tennessee tenant is not advised that landlord is in default to bank and property is in foreclosure. Tenant (a teacher) goes on vacation for a month. Upon return, locks are changed and ALL property (including financial records, family memoirs, photos, furniture, kitchenware, appliances, computer, EVERYTHING, even CAR) is GONE.
Tenant has paid rent to landlord on time every month for 2+ years.
Seems while tenant was away, bank foreclosed on the property, removed all of tenant’s personal belongings and sold the lot to some salvage operator 700 miles away.
Tenant was able to locate car, but told it will cost $1500 in towing and storage fees to get it back.
Can this really happen? Does tenant have any rcourse? Against whom – landlord? bank?
i am sorry you did not ask a relative or
close friend to look in on your unit every
other day……just like watching a pet.
YOU naturally have recourse against
the landlord.
I hope you had some insurance.

NOT the bank.
My point of couriosity; did you prepay
more than one month’s rent?
If you had been held up a few days,
on vacation, how would you have
handled things?
Check to see if your mail has any notices re the foreclosure.
ONE thing here does not make sense thus, you have some additional recourse;
you had to be told by anyone who tried to evict you and you had to be sued.
IF you were not, you have recourse against the lender.
