my timeshare is paid off being foreclosed because i’m behind on maint. dues, while I get the surplus from sale?

My timeshare is completely paid off. Because we are unable to keep up with the monthly maintenance fees, the timeshare company (silverleaf resorts) HAS proceed to foreclose our timeshare. Are we entitled to the surplus from the foreclosure sell. the lien is only 900.00. our timeshare was purchased in 2001 in a prime location.

Honestly, I’m surprised that the resort let you go via foreclosure. Maintnance fees are normally protected by the timeshare contract and not by the property, i.e. mortgage. Make sure that it’s a foreclosure. I’ve seen garnishing of wages and defaults judgments for non-payment of maintenance fees.
