You need an Attorney

I recommend that you interview at least 3 or 4 Attorneys who have a great deal of experience with real estate cases that involve foreclosure and tenants in the property.

You may have to involve the court in what is called “interpleader” where you deposit your rent money with the court and let the court decide whether the money is owed to the landlord or the bank.

In foreclosure, the bank has the right to collect rent from the tenants.

However in this case you do not know who is the legal owner of the house.

That is why you need an Attorney with a great deal of successful experience in this area of the law.

Also, most rental agreements provide that in the event of a dispute, the winner has the right to collect legal fees from the loser.

You landlord will almost certainly lose this case if the facts are as you have described them. You will also get a judgment from the court against your landlord for Attorney’s fees if your written rental agreement provides for that as most do.
