Delay foreclosure sale (California)?
My friends’s house is going on a foreclosure sale. She was told by another fried that she could gain some more time to arrange to move out by delaying the sale for another 40 days. Supposedly there is a process where you can challenge the trustee group to prove they were in compliance with the California foreclosure procedure. If this is true, does anyone know how to do this or where to find the information on how to do this?
You need to have a real estate attorney to file suit and ask for a stay. Be prepared to pay $5000+ in legal fees and then still lose the case. A Trustee Sale in California is very cut and dry and it very doubtful that the lender did anything wrong. Your friend would have to prove lender fraud.
kemperk obviously doesn’t have a clue about a Trustee Sale in California. The whole process takes 120 days, from filing the Notice of Default to the final Trustee Sale. There is no court proceeding whatsoever.
