Forbearance Foreclosure
Do we have a case about our house?
Me and my husband are in the foreclosure process because he lost his job from this spiraling economy. Anyways we were able to get a forbearance process started. We were told to make the four payments that were stated and then we would be able to get the forbearance. Well we made all four montly payments and now we get a letter stating that we are being foreclosed on next week. We were shocked. After calling the bank they told us it was because we didnt call them enough. Whhhhaattt are you serious. Do we have a case to take them to court for breach of contract? Any help would be appreciated. Thanks
Of course you don’t have a case. What contract did the bank breach ? Do you have something in writing from the bank promising a forebearance in return for those payments ? I’d guess not. But the bank DOES have your original mortgage contract which you are failing to honor. That puts YOU in breach of contract, and the bank can foreclose.
